Travel Services Agreement
Please review the following Travel Terms and Conditions of Matthews Travel Group. The purchase of your travel booking constitutes a contractual agreement between the traveler(s), customer(s), and/or purchaser(s), (collectively as “You“,”Traveler“,”Passenger“), and Matthews Travel Group, LLC (“Matthews Travel Group“, “We”, “Us“) pursuant to the following terms and conditions (“Terms”, “Agreement”):

IMPORTANT CONDITIONS:
Prices are subject to increase prior to the time you make full payment. Prices are not subject to increase after you make full payment, except for charges resulting from increases in government-imposed taxes or fees. By signing below, you expressly acknowledge your acceptance of these conditions (i.e. increases before full payment and increases attributable to government-imposed taxes or fees after full payment will be your responsibility) applicable to your purchase.
PLANNING FEE, DEPOSIT AND FINAL PAYMENT:
You will be required to pay a Travel Planning Fee when booking services provided by Matthews Travel Group.
All Travel Planning Fees paid to Matthews Travel Group are 100% non-refundable.
The service provider or supplier may require further deposits. All deposits are non-refundable unless otherwise stated in provider, supplier, or vendor payment terms. Final payment is required no less than 60 days prior to departure unless otherwise stated.
Matthews Travel Group holds reservations until “Deposit Due Date” indicated on your confirmation. If deposit/payment is not received by Matthews Travel Group on or before the Deposit Due Date, reservations are automatically cancelled. Failure to remit payments on a timely basis will automatically put your booking at risk of cancellation. Please contact us immediately, and in advance of your payment due date, if you will be unable to meet this obligation. Without limitation, Passenger(s) voluntarily hold Matthews Travel Group harmless for cancellation of any booking for either late payment or declination of a credit card.
Some airfares or services must be paid in full at the time of booking. Matthews Travel Group accepts debit card or credit cards (AMEX, Visa, MasterCard, Discover). Should you wish us to charge your credit card we may require you to read and sign a credit card authorization form.
CANCELLATION:
We understand that circumstances change and it may become necessary to cancel your travel plans. Please be aware that most travel bookings are non-refundable and cancelled bookings will incur charges. These charges can be up to 100% of the cost of the booking, regardless of whether travel has commenced. Where we incur any liability for a cancellation fee or charge for any booking which you cancel, you agree to indemnify us for the amount of that fee or charge.
Once travel is booked, traveler(s) will be responsible for the following cancellation fee(s) in addition of any supplier charges:
A cancellation fee of $150 per booking will be accessed once booking has been made to service the cancellation of your travel.
Since our agency is compensated from the tour/hotel/cruise companies that we book once a trip is completed, this fee is to cover our time spent thus far servicing your request. All service fees are non-refundable and non-transferable.
TRAVEL PROTECTION:
For your protection, we strongly recommend that you purchase trip cancellation and travel accident insurance. For your convenience, we offer Travel Protection Plans which includes these benefits. Travel Insurance benefits are offered by Travel Guard Group, part of the AIG family or the travel suppliers. However, no representation or description of the insurance made by Matthews Travel Group to you, constitutes a binding assurance or promise about the insurance. Matthews Travel Group is not an insurance company and has no responsibility for the submission, payment or adjustment of any insurance claims. Any insurance claims that may fall under the relevant travel insurance policy must be submitted to the insurance company identified in the policy.
CREDIT CARD TRANSACTIONS:
If for any reason, any travel service provider is unable to provide the services for which you have contracted, your remedy lies against the provider, and not against Matthews Travel Group and in the event that payment has been made to Matthews Travel Group by credit card, you agree that you will not seek to chargeback your payment to Matthews Travel Group. If the credit card is passed through to the travel services provider and you seek to chargeback your payment from the provider, you agree to be held liable and indemnify Matthews Travel Group against this chargeback from the provider, including without limitation any air debit memos charged to Matthews Travel Group. If Matthews Travel Group incurs any costs, including but not limited to attorneys’ fees to recover any payments charged back by your credit card company, you agree that you will be liable for these costs. If the credit card is declined, we will attempt to contact you to use another card. If multiple cards are declined, we will cancel your trip and you will be charged a cancellation fee. You guarantee that you will settle any amounts owing to Matthews Travel Group via money order or check immediately.
ADDITIONAL FEES:
Additional taxes and surcharges that cannot be pre-collected may be charged locally by car rental agencies, hotels or other suppliers. Most properties and vehicle rental/leasing companies require a credit card imprint at check-in.
BOOKING ACCURACY/LEGAL NAMES:
Passenger is required to immediately review all aspects of their booking to verify (but not limited to): passenger names, mailing address, email address, telephone, date of birth, pricing, airfare, arrival/departure airports, accommodations and organized activities on your booking invoice. Please notify Matthews Travel Group immediately if any omissions and/or corrections are needed regarding the booking details. Passenger(s) voluntarily assumes full & sole responsibility for any and all risks and/or costs involved with failure to report such errors and/or omissions. Passenger is required to verify the accuracy of the passenger’s LEGAL first & last names. It is mandatory that guest names be identical to the Passenger(s) LEGAL first and last names and identical to the names as they appear on booking and travel documents.
PERSONAL TRAVEL DOCUMENTATION:
Passenger assumes sole responsibility to independently confirm all documentation requirements for all passport, visa, vaccination, or other entry and/or travel requirements of each destination. Passenger assumes sole responsibility for, and hereby releases Matthews Travel Group from any claims or responsibility for any and all damages incurred as a result of Passenger failure to comply with applicable documentation requirements, including but not limited the requirement that all Passengers procure, and have on their person the proper travel documents at all times. Matthews Travel Group recommends the Passenger consult with the appropriate domestic and foreign governmental agencies for the current document requirements.
AGENT/INTERMEDIARY:
Matthews Travel Group is simply an intermediary between the Suppliers and the public. Matthews Travel Group does not own or operate any of, hotels, shore excursions, tours, transportation providers, cruise lines, vessels, airlines, travel protection companies, attractions, or other travel-related Suppliers who provide goods or services for the Passenger(s)’ trip. Passenger(s) acknowledge and agree that Matthews Travel Group shall not be responsible for any loss, damage, delay, inconvenience or injury to Passenger(s) or group members as a result of a breach of contract, act or omission whether willful or negligent, criminal or otherwise of any person other than Matthews Travel Group or its direct employees, including but not limited to these Suppliers, their employees, agents, servants, or representatives.
Suppliers reserve the right to deviate from the direct, customary and/or scheduled route or itinerary for any reason, without limitation and without notice. Passenger(s) acknowledge and agree that Matthews Travel Group is not responsible for Supplier deviations, delays, cancellations, mandated overnight stays, missed connections or any other condition beyond its control.
While Matthews Travel Group prides itself on selecting top quality Suppliers, no undertaking, guarantee or warranty is given or shall be implied as to the fitness or condition of the Supplier’s accommodations, transportation, or any food, drink, medicine, or provisions supplied. Passenger(s) acknowledge and agree that Matthews Travel Group shall not be responsible for refunding, either fully or partially, any amounts paid due to unsatisfactory services from any supplier. In no event shall Matthews Travel Group be liable for any accident which occurs in hotels, in resorts, on airplanes/in airports, on buses/in bus stations, on trains/in train stations, on board a cruise ship, on tenders, on shore excursions, or during any mode of transportation encountered during the trip, resulting from equipment or any other cause. The Passenger admits a full understanding of the nature and character of the mode of transport and assumes all risks of travel, transportation and handling of passengers and baggage.
Matthews Travel Group has no liability for Suppliers acts or omissions or for events beyond the Matthews Travel Group control. Matthews Travel Group has no control over Supplier refund timeliness or status. If Passenger(s) accept future-travel credit in lieu of refunds, Passengers(s) acknowledge and agree Matthews Travel Group has no liability for a Supplier failure to honor future travel credit. Matthews Travel Group has no special knowledge of any Supplier financial condition and no liability for recommending a credit.
LIMITATION OF LIABILITY:
Without limitation, Passenger(s) assume the risk of, and agree that Matthews Travel Group is not liable for any damages arising from or related to any act of God or public enemies, arrest, restraints of any government or rulers of people, piracy, war, revolution, extortion, terrorist activity, threatened or actual rebellion, political upheaval, civil unrest, riots, fire, lockouts, explosion, collision, weather conditions, dangers incident to the sea, mechanical or construction failures or difficulties, diseases, local laws, abnormal conditions or developments, closure of airports/seaports/hotels/train stations, carrier or supplier logistical problems, computer problems stranding, food or water poisoning, illness, grounding, perils of the sea, rivers, canals, locks or other waters, perils of navigation of any kind, theft, accident to or from machinery, boilers, or latent defects even though existing at commencement of the trip, desertion or revolt of crew, or lost/damaged/delayed luggage.
MODIFICATION OF TERMS AND CONDITIONS:
The Terms and Conditions may be amended or modified by Matthews Travel Group at any time without notice.
Only those who have accepted the Terms and Conditions and affirmatively indicated their consent to be bound by the Terms and Conditions may make a booking with Matthews Travel Group.
The failure of Matthews Travel Group act with respect to a breach of these Terms and Conditions by you, or others, does not waive its right to act with respect to subsequent or similar breaches. Matthews Travel Group does not guarantee it will take action against all breaches of this these Terms and Conditions.
